Noon Interview: Power of Attorney For Snow Birds


If you live in the north country, but spend your winters in Florida, you might want to make sure your Power of Attorney is in order.

The state of Florida will have a new Power of Attorney law placed into affect October 1, 2011. 

Although a New York power of attorney document can be used in Florida, the execution has to be compliant with New York state's requirements. 

When a document is presented to a third party for use, the third party may now request a legal opinion as to its validity.

Who foots the bill?  You as the principal. 

Next, even if the document was validly executed out-of-state, Florida law will be used to interpret the extent/scope of power authorized. 

Watertown attorney Lucy Gerviss said it might be worth your time to talk to an attorney licensed in both states who is familiar with the new law, or an attorney in Florida who can review your New York document to meet your needs in Florida.
