The Law And Water Rights


When it comes to water rights, the law weighs different things including the public's right to use, the state's ownership of the land below the highwater mark and the waterfront property owner's right of access/wharfage.

Watertown lawyer Keith Caughlin of Schwerzmann & Wise, P.C. appeared on 7 News at Noon on Monday to discuss water rights.

He says while navigability remains an important legal issue, the more current interest is on recreational access via private docks and boathouses.

The docks and boathouses are regulated by neighbors in an informal sense and different government agencies regulate in a formal sense.
