Lawyers for Specialist Trevor Loope, 23, say he is going to be unfairly court martialled.

The Fort Drum soldier went AWOL after serving 15 months in Afghanistan.

Loope turned himself in last December and is facing criminal action.

However, Citizen Soldier, a soldier's rights group is stating that Loope suffered from a severe case of post traumatic stress syndrome.

At the time, Loope and lawyers claim that he did not received the help he needed to overcome his condition.

Loope appeared in front of a sanity board on June 18, which was supposed to determine whether or not he's fit to stand military trial.
