Felony Sex Charges Against Norfolk Couple To Be Dropped

A Norfolk couple accused of forcing a Massena woman to have sex will have the felony charges dropped because of "evidentiary issues" and "inconsistencies" with the alleged victim.

32 year old Nathaniel Dodson and his 31 year old wife Bobbi Jo were initially charged by Massena Village Police with rape, criminal sexual act and burglary in October 2012.

At the time, Police said the couple broke into a woman's Water Street home and forced her to engage in sexual acts with them.

The couple and the alleged victim were acquaintances, police said.

The case was originally prosecuted by former District Attorney Nicole Duve but had not been resolved.

The Dodson's were given an Adjournment in Contemplation of Dismissal in Massena Village Court based on an original plea bargain with Duve.

District Attorney Mary Rain told 7  News the original charges had been reduced to misdemeanor trespass and assault by the previous administration before the court granted the ACD.

Rain said " inconsistencies with the alleged victims statements as well as evidentiary issues did not support the charges."
