Judge Mulls Oxley Lawsuit
A state Supreme Court judge has reserved his decision on whether to allow Wayne Oxley's mult-million dollar lawsuit against the city of Ogdensburg and its police department.Malone attorney John Muldowney, who represents the city, said the lawsuit should be dismissed because it was filed late. Muldowney also told the court "there are insufficient facts to support any of the claims in the complaint." "I disagree wholeheartedly," Oxley told the court. Oxley said "there was much perjury from the trial from the officers." Oxley filed the wrongful imprisonment suit, claiming his constitutional and civil rights were violated. "I lost almost seven years of my life and that's worth a little something besides the final conclusion that I was wrongly convicted and tried," said Oxley. A St. Lawrence County jury acquitted Oxley of murder charges at the end of his third trial in February. He was accused of beating Bernard Trickey Jr. to death with a baseball bat in August 2005.
