Juror Removed In Wayne Oxley Murder Trial

A juror, who said she had a dream that murder suspect Wayne Oxley was chasing her with a baseball bat, is off the jury in Oxley's trial.

However, her removal has nothing to do with the dream; it has to do with transportation issues.

Judge Jerome Richards removed the juror in a ruling - characterizing her as "grossly disqualified" after she told the court her husband's new job in Watertown required her to transport him daily before and after the trial.

She was replaced by a female alternate, keeping the jury's makeup at 10 women and two men.

Testimony in the case has focused on scientific evidence from prosecution expert witnesses.

A forensic pathologist told the court Friday he could not definitely rule out whether murder victim Bernard Trickey may have been shot in the head prior to being severely beaten or whether more than one bat was used in the murder.

This is Oxley's third trial on the murder charge.

His first trial in the August 2005 baseball bat beating death of 38 year old Bernard Trickey ended with a murder conviction that was later overturned by a state court.

A second trial in 2010 ended in a hung jury.
