Lawmakers Mull Tougher Drug & Gun Seizure Laws

Jefferson County lawmakers have put off a decision on a new law targeting drugs and guns.

The proposed law would allow police to seize personal property allegedly involved in misdemeanor drug and gun crimes.

The county legislature voted Tuesday night to send the bill back to committee for more discussion.

 

Right now, only those charged with felony drug and gun crimes can have their property taken by law enforcement. 

Under the proposed law, those charged with less serious misdemeanors could face the same treatment.

"I think it provides another deterrent and it provides greater law enforcement efforts out there to try and curb the sale and distribution of drugs," said Republican District 13 Legislator Scott Gray before Tuesday's meeting.

Gray says safeguards are built into the law. 

For instance, court permission would be needed before property could be seized.

"It is strictly to clean up, as best we can, our neighborhoods," said Gray.

But, Republican District 10 Legislator Mike Behling says misdemeanors shouldn't be treated like felonies.

"I think its just another nail in the coffin of giving away our rights here in America.  I don't want to see that happen," he said.

Behling plans to vote against the law when the time comes, but he's not sure it will do much good.

"I hope that it does not pass because it's not right.  If it does, if the public doesn't show up and say that they disagree with this, it probably will pass," he said.

Legislators considered a similar law in 2007.

It went a little further, including drunk drivers in those who could be subject to seizures. 

That legislation was unsuccessful.
