Opening Statements in Oxley Trial Expected Tuesday

The jury has been seated, and opening statements are expected Tuesday in the third murder trial of Wayne Oxley of Ogdensburg. Oxley is accused of beating Bernard Trickey to death with a baseball bat in 2005.

Both District Attorney Nicole Duve and Oxley's new court appointed attorney are expected to present new witnesses, testimony, and evidence as the trial goes forward. There are 130 potential witnesses, including 90 who may be called in Oxley's defense.

Oxley has maintained his innocence and says he is looking forward to taking the witness stand in his own defense.

Oxley contends the man who killed Trickey died in a suspicious house fire.

Oxley is paying for his public defender in this trial. He is being represented by Peter Dumas of Malone.

His first trial ended with a murder conviction that was later overturned by a state court. A second trial in 2010 ended in a hung jury.
