Prison Sentence Stands In Ogdensburg Stabbing Case

A state court has refused to overturn the prison sentence of a Potsdam man serving 12 years to life in connection with an Ogdensburg stabbing.
 
David Clemons, 47, was convicted of second-degree assault for stabbing Brett Burk in the back with a knife during a Morris Street fight in October 2007.

The knife attack punctured Burk's lung.

Clemons was sentenced as a repeat felony offender.

Clemons claimed he didn't understand when he signed a waiver of his right to appeal.

The state Court of Appeals found that Clemons was advised by his attorney when he voluntarily signed the appeal waiver.

Clemons remains held in the Great Meadow Correctional Facility in Ontario County and will be up for a parole hearing in November 2020.
