Special Prosecutor Could Investigate Hallet Case

It's a long awaited response for Jefferson County Legislators.

An answer to their question: will the New York State Attorney General's Office lead an investigation into the Sheriff's Department's handling of a incident involving one of its own?

It was something called for by county Legislators after Deputy Adam Hallett (pictured) was found in his patrol car with an open bottle of alcohol last December.

But legislators aren't happy with the answer they got.

"We're in a quandary right now. It's tough. It's been very tough for us," said Legislature Chairwoman Carolyn Fitzpatrick.

Officials from the AG's office told 7 News they will "offer oversight and suggestions on policies and procedures."

As for why it won't actually lead the investigation?

Officials said, "That's why they (Jefferson County) have a district attorney. That's why residents pay taxes."

District Attorney Cindy Intschert declined to comment.

Officials from the AG's office did meet with Sheriff John Burns to review polices and the department's code of conduct.

Fitzpatrick and County Attorney David Paulsen.

"We're the ones that asked for the help and guidance and yet we got nothing. We're told to figure it out for ourselves. But they're going ahead and meeting with the sheriff," said Fitzpatrick.

Fitzpatrick says the board may now turn to a special prosecutor, but either way, the investigation will continue.
