A Buffalo-area man faces charges for allegedly driving with a 10 year old child in the car when his blood alcohol level was nearly three times the legal limit.

State police say they pulled over 42 year old Mark Dlugolinski of Grand Island, N.Y. for driving recklessly on Route 11 in the town of Dekalb.

He was charged under what's called Leandra's Law because of the underage passenger. He faces one count of aggravated driving while intoxicated for that and another for driving with a blood alcohol content (BAC) of .18 percent or more.

Troopers say his BAC was .23 percent.

He was also charged with failure to jeep right, moving from a lane unsafely and consuming alcohol in a motor vehicle.

Dlugolinski was arraigned in Fowler town court and sent to St. Lawrence County jail on $3,000 bail.
