Accused Rapist Challenges Statement, Evidence

A suspended SUNY Potsdam student accused of rape is challenging the validity of a statement he gave police as well as a search warrant.

Storm Rivera was in St. Lawrence County Court Monday for a hearing.   

His attorney, Ed Narrow, told  the judge the 22 year old was not properly informed of his Miranda rights. 

He also challenges how police processed evidence gathered at the Delta Kappa fraternity house, where the rape is alleged to have occurred in November of last year. 

Prosecutors argued both the search warrant and statement are valid. 

No trial date has been set.
