Man accused of altering woman’s Facebook photos to appear nude

BIRMINGHAM, Ala. (WBRC/Gray News) - A man is facing charges after police say he altered a woman’s Facebook photos to make it appear she was nude, then sent the images by text without her consent.

According to criminal complaints filed April 30 in Jefferson County District Court, David Heinrich Elliott is charged with two counts of distributing a private image.

The charge is considered a misdemeanor under Alabama law.

Investigators allege that on or around April 10, Elliott took photos from the victim’s Facebook page and digitally altered them so that she appeared to be nude. The complaints say Elliott then texted those altered images to another person.

The filings said the woman did not consent in writing to the transmission of the images and had a reasonable expectation of privacy against their distribution, elements required under Alabama’s “distribute private image” statute.
